1Postanowienia ogólne
Regulamin określa zasady korzystania z serwisu internetowego dostępnego pod adresem impressitem.com (dalej: „Serwis”) oraz zasady świadczenia usług drogą elektroniczną w rozumieniu ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną.
Usługodawcą jest ImpressItem P.S.A. z siedzibą w Krośnie, ul. Franciszka Żwirki i Stanisława Wigury 6C, 38-400 Krosno, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego pod numerem KRS 0001199718, NIP 6842685094, REGON 542988492 (dalej: „Usługodawca”).

Użytkownikiem jest każda osoba korzystająca z Serwisu. Korzystanie z Serwisu oznacza akceptację Regulaminu.
2Rodzaje i zakres usług
Usługodawca świadczy za pośrednictwem Serwisu następujące bezpłatne usługi:
- udostępnianie treści informacyjnych o Usługodawcy, rozwijanych przez niego rozwiązaniach oraz realizowanych projektach,
- formularz kontaktowy umożliwiający przesłanie wiadomości do Usługodawcy,
- publikację zapytań ofertowych w zakładce „Zamówienia”.
3Wymagania techniczne
Do korzystania z Serwisu potrzebne są: urządzenie z dostępem do Internetu, aktualna przeglądarka internetowa z włączoną obsługą JavaScript i plików cookies, a do skorzystania z formularza kontaktowego – także aktywny adres e-mail.
4Zasady korzystania z Serwisu
Użytkownik zobowiązany jest korzystać z Serwisu zgodnie z prawem, Regulaminem i dobrymi obyczajami. Zabronione jest w szczególności:
- dostarczanie treści o charakterze bezprawnym,
- przesyłanie niezamówionych informacji handlowych (spamu),
- podejmowanie działań mogących zakłócić działanie Serwisu, w tym prób obejścia jego zabezpieczeń,
- podawanie cudzych lub nieprawdziwych danych.
Serwis stosuje automatyczne zabezpieczenia antyspamowe, które mogą odrzucić wiadomość wysłaną przez formularz. W takim przypadku wiadomość można przesłać na adres e-mail Usługodawcy.
5Zawarcie i rozwiązanie umowy
Umowa o świadczenie usług drogą elektroniczną zostaje zawarta z chwilą rozpoczęcia korzystania z Serwisu i ulega rozwiązaniu z chwilą jego opuszczenia. W przypadku formularza kontaktowego umowa zostaje zawarta z chwilą wysłania wiadomości i wygasa po jej doręczeniu Usługodawcy. Użytkownik może w każdej chwili zakończyć korzystanie z Serwisu bez podawania przyczyny i bez ponoszenia kosztów.
6Charakter informacyjny treści
Treści zamieszczone w Serwisie, w tym opisy funkcji aplikacji ImpressItem, mają charakter informacyjny i nie stanowią oferty w rozumieniu art. 66 Kodeksu cywilnego. Opisywane rozwiązanie jest w fazie rozwoju, a jego funkcje i termin udostępnienia mogą ulec zmianie. Zasady korzystania z aplikacji zostaną określone w odrębnym regulaminie.
Warunki udziału w postępowaniach publikowanych w zakładce „Zamówienia” określa każdorazowo treść danego zapytania ofertowego.
7Własność intelektualna
Serwis oraz zamieszczone w nim treści, w szczególności teksty, grafiki, logotypy i układ strony, podlegają ochronie prawnej i przysługują Usługodawcy lub podmiotom, które udzieliły mu stosownych uprawnień. Korzystanie z nich w zakresie wykraczającym poza dozwolony użytek wymaga uprzedniej zgody Usługodawcy.
8Odpowiedzialność
Usługodawca dokłada starań, aby Serwis działał poprawnie i nieprzerwanie, a zamieszczone w nim informacje były aktualne. Usługodawca zastrzega możliwość przerw technicznych związanych z konserwacją lub rozbudową Serwisu. W granicach dopuszczalnych przez prawo Usługodawca nie odpowiada za przerwy w działaniu Serwisu wynikające z przyczyn od niego niezależnych ani za treść stron zewnętrznych, do których prowadzą odnośniki. Postanowienia Regulaminu nie ograniczają praw konsumentów wynikających z bezwzględnie obowiązujących przepisów.
9Reklamacje
Reklamacje dotyczące działania Serwisu można zgłaszać na adres administracja@impressitem.com. Zgłoszenie powinno zawierać opis problemu oraz dane kontaktowe zgłaszającego. Usługodawca rozpatruje reklamację w terminie 14 dni od jej otrzymania i udziela odpowiedzi na adres e-mail, z którego została wysłana.
10Pozasądowe rozwiązywanie sporów
Użytkownik będący konsumentem może skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, w szczególności zwrócić się o pomoc do miejskiego lub powiatowego rzecznika konsumentów albo do wojewódzkiego inspektoratu Inspekcji Handlowej. Informacje o dostępnych procedurach znajdują się na stronie Urzędu Ochrony Konkurencji i Konsumentów (uokik.gov.pl).
11Dane osobowe
Zasady przetwarzania danych osobowych oraz wykorzystywania plików cookies opisuje Polityka prywatności.
12Postanowienia końcowe
Usługodawca może zmienić Regulamin z ważnych przyczyn, w szczególności w razie zmiany przepisów prawa lub zakresu świadczonych usług. Aktualna wersja Regulaminu jest dostępna w Serwisie. W sprawach nieuregulowanych stosuje się przepisy prawa polskiego.
1General provisions
These Terms set out the rules for using the website available at impressitem.com (the “Website”) and for the provision of electronic services within the meaning of the Polish Act of 18 July 2002 on the Provision of Electronic Services. In the event of any discrepancy, the Polish version prevails.
The service provider is ImpressItem P.S.A. with its registered office in Krosno, ul. Franciszka Żwirki i Stanisława Wigury 6C, 38-400 Krosno, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS No. 0001199718, NIP (tax ID) 6842685094, REGON 542988492 (the “Service Provider”).

A user is any person using the Website. Using the Website constitutes acceptance of these Terms.
2Types and scope of services
The Service Provider provides the following free services through the Website:
- access to information about the Service Provider, the solutions it is developing and the projects it carries out,
- a contact form for sending a message to the Service Provider,
- publication of requests for quotation in the “Procurement” section.
3Technical requirements
Using the Website requires a device with Internet access and an up-to-date web browser with JavaScript and cookies enabled; using the contact form also requires an active e-mail address.
4Rules of use
Users must use the Website in accordance with the law, these Terms and good practice. In particular, it is prohibited to:
- provide unlawful content,
- send unsolicited commercial communications (spam),
- take actions that may disrupt the Website, including attempts to circumvent its security measures,
- provide false data or another person's data.
The Website uses automated anti-spam safeguards that may reject a message sent through the form. In that case, the message can be sent to the Service Provider's e-mail address.
5Conclusion and termination of the agreement
The agreement for the provision of electronic services is concluded when the user starts using the Website and is terminated when the user leaves it. For the contact form, the agreement is concluded when the message is sent and expires once it has been delivered to the Service Provider. Users may stop using the Website at any time, without giving a reason and at no cost.
6Informational nature of the content
The content of the Website, including descriptions of the features of the ImpressItem application, is for information purposes only and does not constitute an offer within the meaning of Article 66 of the Polish Civil Code. The solution described is under development, and its features and release date may change. The rules for using the application will be set out in separate terms.
The conditions for taking part in procedures published in the “Procurement” section are set out in each request for quotation.
7Intellectual property
The Website and its content, in particular texts, graphics, logos and page layout, are legally protected and belong to the Service Provider or to entities that have granted it the relevant rights. Any use beyond what is permitted by law requires the prior consent of the Service Provider.
8Liability
The Service Provider makes every effort to ensure that the Website works correctly and without interruption and that the information on it is up to date. The Service Provider reserves the right to technical breaks related to maintenance or development of the Website. To the extent permitted by law, the Service Provider is not liable for interruptions caused by circumstances beyond its control or for the content of external websites linked from the Website. Nothing in these Terms limits consumer rights arising from mandatory provisions of law.
9Complaints
Complaints about the operation of the Website may be sent to administracja@impressitem.com. A complaint should include a description of the problem and the complainant's contact details. The Service Provider will consider the complaint within 14 days of receiving it and reply to the e-mail address from which it was sent.
10Out-of-court dispute resolution
A user who is a consumer may use out-of-court complaint and redress procedures, in particular by seeking assistance from a municipal or district consumer ombudsman or from a regional Trade Inspection inspectorate. Information on the available procedures can be found on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).
11Personal data
The rules for processing personal data and using cookies are described in the Privacy Policy.
12Final provisions
The Service Provider may amend these Terms for important reasons, in particular a change in the law or in the scope of services. The current version of the Terms is available on the Website. Matters not regulated herein are governed by Polish law.
